Like the physical environment, all transactions made in the electronic environment are indicative of making a contract or an agreement. According to the Clause 183 of the Civil Law, a contract or an agreement is made when “one or more persons become committed to do something, and accept such commitment”. Accordingly, an online contract is a contract made by means of “Data Message”.
“Proposal” refers to offering a deal to another person, in such a way that if the said offer is accepted a contract is made. “Acceptance” refers to declaring to be satisfied by the proposed offer. Therefore, when proposal and acceptance are exchanged through data messages, an online contract is made. Accordingly, when the costumer finalizes an order, a contract is made and the costumer is obliged to pay the order value. Please note that making a proposal shall not result in any obligation to the proposer, and the proposer can determine a validity period or any other conditions.
According to the store regulation, inquiring an order is the first step of purchasing products and services; therefore, responding to the costumer’s inquiry is regarded as “proposal” and finalizing the order by the costumer is deemed as “Acceptance”.
Placing an order is deemed declaring to be aware of and agree with the site regulations. Therefore, the costumers are required to read the site regulations carefully and place orders only if they agree with the regulations.
Karmado website may send e-mail or SMS messages to the website users to inform them about events and services. Please note that … is the only number Karmado website uses to send SMS messages to users and costumers. Therefore, sending any SMS messages on the behalf of Karmado by any other number is against the rules and regarded as misusing Karmado’s name. In case you receive such SMS messages, please contact us through any communication channels for taking the legal actions. Also, ………. is Karmado’s sole SMS communication system used to send information regarding order status, events, and website services to the users.
Age Requirement
The users must be at least eighteen (18) years of age to make a purchase on this website; otherwise, the purchase must be made by the parents or the legal guardian. The customer is solely responsible for not observing this requirement.
1. Inquiry and Placing Orders: As stock of goods and prices change frequently, the costumers are required to inquire price and availability of the selected products before making a purchase. In this step an eight-digit tracking number is sent to the customer by e-mail or SMS.
2. Responding to Inquiry and Finalizing the Order: The inquiries are usually responded within two hours after placing the order during the working hours in a normal day, and the customers are informed of the due time for finalizing the order. Afterward, the customer can finalize the order within the due time. If the customer fails to finalize the order within the due time, the order is regarded as incomplete, and the customer can no more finalize the order. In this case, if the customer asks for reactivating the order, and the selected products are still available, the due time will be extended. The customers do not need to sign up the website to send information or even place orders; but Karmado highly recommends to sight up first. An advantage of signing up is not needing to enter your details for future purchases. Moreover, you will be notified of latest news, ascending discounts, and good offers. By submitting this information, users and costumers, being assured that their information is protected by the website, authorize the site to use the submitted information to contact them. The customer is required to enter true and accurate information when placing an order; otherwise, the customer will be solely responsible for potential problems and losses caused by the wrong information. By entering address, e-mail ID, and mobile/telephone number, the customer confirms accuracy of such information, and Karmado is entitled to ask for complimentary information to verify the order only when the above said information are not entered completely and accurately. The costumer can enter a third party address or telephone number for delivery of the order, and if the order is pre-paid, the recipient is required to provide valid ID to receive the order. The delivery address entered by the customer will be indicated in the invoice as well.
3. “Working Day” refers to Saturday to Thursday every week, except for Iranian public holidays. All inquiries are checked and responded during the working days, and the first day after holidays. It is necessary to mention that placing an order on Karmado is possible throughout the year, including public holidays. All inquiries made on Karmado website enter the checking process after sending the tracking code by SMS and system-generated pro-forma invoice by e-mail. We do honor your shopping from Karmado, and Karmado team does its best to delivered the purchased products promptly. However, if the selected product gets out of stock even after placing the order, Karmado reserves the right to cancel the order and refund the paid amount. Alternatively, the customer can choose to replace other products to the unavailable items.
4. In case of problems such as unavailability of the selected products or costumer’s intention to cancel the order, the paid amount shall be refunded to the account introduced by the costumer (in written by e-mail or any other communication channels) within 24 to 48 working hours.
5. In the event of any mistakes in price of the products available on Koarmado website, Karmado reserves the right to cancel the order. Certainly, Karmado shall refund the paid amount to the account introduced by the customer (in written by e-mail or any other communication channels) as soon as possible within 24 to 48 working hours. By making purchases on Karmado website, the costumer confirms to be aware of this regulation and shall not be entitled to make any claims in this regard.
6. Since the orders are system-generated it will not be possible to re-issue the invoice or make any changes to the details, including transferring the invoice addressing a physical person to another physical person.
7. Karmado is a wholesaling and retail website. Therefore, in large orders including larger quantities of products, Karmado is allowed to check the costumer prior to delivery and confirm the sale after the costumer is approved. In this case, the invoiced amount must be paid prior to delivery; otherwise, the order will be canceled after notifying the costumer and the paid amount shall be refund to the costumer’s account with 24 to 48 working hours.
8. Please note that adding products to the cart is not regarded as reserving them and shall not establish any rights for the costumer. Any changes, including changes of price and stock, made before finalizing the order shall be applicable to the products added to the cart. Therefore, costumers who definitely intend to buy products, especially those included in special offers, sales, and festival and those available in limited numbers, are recommended to finalize their order as soon as possible to avoid price changes or running out of stock. It is necessary to mention that an order is deemed finalized when the user receives the final confirmation code by e-mail. Obviously, Karmado shall take no responsibilities for products left in the cart, incomplete orders, and unpaid orders.
9. Retail costumers residing in Tehran can pay for their order online, make debit card transfers, or pay by debit card (using mobile POS) upon delivery. Of course, for orders above five million IRR, it is mandatory to pay ten percent of the order value online to guarantee the order.
10. Costumers from other cities are required to pay the total value of order online or using debit card transfers, so that the purchases products are couriered to them. The courier tracking code shall be sent to the costumer for tracking the parcel.
- In Tehran, the orders are delivered only by Snap Box.
- In cities near Tehran, the orders can be delivered by courier companies in addition to Snap Box. The transportation fee shall be paid by the costumer.
- In other provinces, the orders can be delivered by I.R. Iran Post or by the courier companies, which can be occasionally selected by the costumer.
- When placing the order and sending inquiries, the customers may choose either of the possible delivery methods. Selecting a delivery method amounts for being aware of the respective terms and conditions.
- Where the order is selected to be delivered by post or courier companies, the store’s responsibility is limited to deliver the order as soon as possible in good shape to the post or courier company and send the tracking code to the costumer.
- In Tehran, express delivery time is less than three hours, and normal delivery time is maximum one working day.
- In Tehran, due to unpredictable issues, like traffic jams and unexpected events, the orders are delivered in a two or three-hour timespan that will be coordinated by the costumer. The costumer is required to be available at the delivery address in the coordinated timespan; otherwise the costumer will be responsible for paying the redelivery costs.
- The orders selected to be delivered by post or courier companies will be delivered to the post or courier company on the same day, provided that the order is completed before 12 o’clock. Orders completed after 12 o’clock shall be delivered to post or courier company on the next working day. Post and courier companies normally deliver the orders with 24 to 48 working hours.
- The respected costumers are required to check specifications of the delivered products with their order upon delivery and before opening the package, and return the parcel if any discrepancies are observed.
- The respected costumers are required to receive the ordered products in good shape; i.e. to check all visible parts of the delivered goods and make sure that no visible defects are observed. Please note that after confirming receipt of the products in good shape, the store shall take no responsibility for the visible defects.
If the package has a visible problem or signs of impact or potential problems are observed, the costumer is required to refrain receiving the parcel, prepare the respective minute, and inform Karmado immediately about the issue.
- When the order is delivered by post or courier company, the respected costumers are required to make sure that the package has no visible defects in front of the delivery person before signing the receipt. If any visible defects are observed, the costumer is required to refrain from receiving the parcel, ask for the respective minute, and inform Karmado immediately of the issue. In such cases, if the costumer signs the receipt (that means declaring to have received the order in good shape) without checking the parcel, the costumer shall no more be entitled to make any claim regarding the visible defects; because the costumer has personally confirmed receipt of the delivered products in good shape, and there is no way for the costumer to claim compensation.
- According to the Cyber Police instructions, it is mandatory to provide a valid ID with the costumer’s name to collect the orders paid online. If the person who places the order and pays the amount online intends to have the order delivered to a third person, details of the recipient must have been communicated to the store through the panel, email, or SMS; otherwise the store shall not deliver the order and the costumer is liable of paying the redelivery costs.
- According to the site regulation, orders that are selected to be paid upon delivery has to be fully paid before collection. After paying the order, the costumer will have enough time to make sure that the order has been delivered in good shape in front of the site representative, and sign the receipt. After visual receipt of the ordered products, the costumer will have seven days to check the products technically. If any technical defects are observed and confirmed by the respective after-sale services staff, according to the E-Commerce Law, the goods will be subject to the Seven-Day Gold Guarantee Law and will be replaced.
- It is possible to discuss and exchange ideas with other users, comment, make suggestions, and ask questions on the website. However, the users are required not to post any contents against the law and ethics, containing defamation and threats to the privacy of individuals, violating the intellectual property rights, or any other inappropriate content; otherwise they shall be solely responsible for any legal consequences.
- The Store is reserves the full right of publishing or not publishing the users’ feedbacks.
- If the user fails to observe the site regulations in comments, the store is entitled to block the user’s access to the website and take legal actions against the user if necessary.
